Welcome to WordPress Club SA (the “Club,” “we,” “us,” or “our”). By accessing or using our website and services, you agree to be bound by these Terms and Conditions.

1. Membership and Access

• Eligibility: Membership is available to individuals who are at least 18 years old. By purchasing a membership, you affirm that you meet this age requirement.
• Account Security: You are responsible for maintaining the confidentiality of your account details and are fully responsible for all activities that occur under your account. You must notify us immediately of any unauthorised use.
• Acceptable Use: You agree not to use the services for any illegal, harmful, or unauthorised purpose, including the direct selling or sharing of the files outside of your own legitimate use.

2. General Public License (GPL) and Product Use

• License Model: All digital products (plugins and themes) offered by the Club are licensed under the GNU General Public License (GPL). We redistribute these items legally, having purchased the original licenses ourselves.
• Redistribution Clarification: Your membership grants you access to download and use the GPL-licensed files for your personal or client projects. This access does not include the original author’s proprietary support, automatic updates via the developer’s license key, or their specific documentation.
• No Warranty: Products are provided “as is” without warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We are not responsible for any damage or loss caused by the use or misuse of the products.

3. Payment, Renewal, and Refunds

• Fees: All fees for membership are clearly stated on the website. We reserve the right to change fees, but any changes will only apply to future membership renewals.
• Automatic Renewal (If Applicable): If your membership is set to auto-renew, you authorise us to charge the applicable fee to your payment method on file on the renewal date. You can cancel the auto-renewal at any time via your account dashboard.
• Refund Policy: Due to the nature of digital goods (instant access to downloadable products), we generally do not offer refunds once the membership or product access has been granted. Exceptions may be made at our sole discretion for technical failures or if the product is proven to be non-functional, provided the request is made within a specified period (e.g., 7 days) of purchase.

4. Intellectual Property

• Club Content: All original content on the WordPress Club SA website (including site design, text, logos, and graphics, but excluding the third-party GPL products) is the property of the Club and is protected by copyright law.
• Trademarks: WordPress Club SA is not affiliated with or endorsed by any trademark holders of the redistributed products, including WordPress, WooCommerce, or others.

5. Limitation of Liability

In no event shall WordPress Club SA, nor its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the services;
• Any conduct or content of any third party on the services; or
• Any defects in the GPL-licensed products.

6. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of South Africa. You agree that the courts of the Northern Free State, South Africa, will have exclusive jurisdiction over any claim or dispute arising out of or relating to these Terms.
